Cherry Hill, New Jersey Bankruptcy Attorneys

Helping Clients in Cherry Hill, Haddonfield, and throughout Camden County

You didn’t borrow money from your creditors with the intention of defaulting on your loans; however, despite laws that are meant to protect borrowers from harassment by collection agencies, you’re getting threatening calls at your home and work about delinquent accounts. Sometimes, it’s just not possible to pay all of your bills and have enough left to live. To make matters worse, you may be worried about losing your home to foreclosure. The bankruptcy attorneys of the New Jersey law firm of Jenkins Law Group offer solutions for the residents of Cherry Hill and Camden County who have fallen behind on payments. We offer our clients immediate relief from creditors and collection agencies, and we are able to stop wage garnishments and foreclosure proceedings.

Bankruptcy and Debt Relief Attorneys

At Jenkins Law Group, our attorneys recognize that not every delinquent account necessarily requires a Chapter 7 or Chapter 13 bankruptcy. We will review non-bankruptcy alternatives with you if they are appropriate. When it’s just not possible to bring your accounts current, however, we can walk you through the bankruptcy process so that you can begin restructuring your life.

Chapter 7 and 13 Bankruptcy in New Jersey

Chapter 7 bankruptcy is often referred to as a “total discharge” of your dischargeable debts. If you successfully complete a Chapter 7, you will no longer owe anything to most or all of your creditors. If you own a home and you’ve managed to keep your mortgage payments current, and the home does not have any non-exempt equity, you can keep your home in a Chapter 7 bankruptcy.

Chapter 13 bankruptcy is usually used when you are behind on something you want to keep (house, car, etc.). In such an instance, you would need a “paying kind” of bankruptcy so that you could repay creditors through a Chapter 13 Trustee. Many times, in a Chapter 13, you are also able to drastically reduce or eliminate unsecured debts, such as credit cards and medical bills.

This automatic stay applies to both types of bankruptcy. What this means is that when you file for bankruptcy, creditors cannot call you, write to you, sue you, or sell or seize any of your assets. If any Court proceedings have started, they must stop. It also freezes the foreclosure process. For a more in-depth discussion of Chapter 7, Chapter 13, and the automatic stay, contact the Camden County bankruptcy law firm of Jenkins Law Group.
